Many business owners have adhered to a law passed in 1985, Civil Code section 1748.1, which prohibited merchants from adding a surcharge (an extra fee) when customers pay by credit card instead of cash. The law did allow merchants to give customers discounts for paying by cash, check, or debit card, as long as that discount is offered to all customers. This law was overturned, but many businesses weren’t aware. Further, while surcharges may be lawful there are still a host of rules regarding when and how they can be charged. This seminar will cover the current law, and how businesses can lawfully charge a surcharge.
